Karpal: Lim Didn't Refuse to Cooperate with police
DAP National Chairman Karpal Singh refuted the allegation by Selangor police chief Datuk Khalid Abu Bakar that Penang Chief Minister and DAP Secretary-General Lim Guan Eng refused to cooperate with police in giving a statement last Saturday.
Karpal said Lim had prior to that requested that he be supplied a copy of the police report before giving his statement under Section 112 of the Criminal Procedure Code (CPC).
"The Chief Minister had made it very clear that he was not refusing to make the statement but required a copy of the police report," he said, adding that the police report would ensure whatever he said would be the truth as he was bound to state the truth.
Karpal said that under Section 193 of the Penal Code for giving false evidence or fabricating false evidence, and under Section 203 for giving false information, the offender could face a jail sentence or a fine or both.
"It is necessity in law, for a police officer recording a statement under Section 112 (of the CPC) to supply a witness before his statement is taken, the police report to enable the witness, in the context of the allegation in the report, to state the truth," he told a press conference, here, today.
Yesterday, a local English newspaper reported that Khalid had warned Lim that police would not hesitate to arrest him if he failed to give his statement on alleged sedition.
Lim is being investigated for allegedly making a seditious remark during the Pakatan Rakyat convention that political aide Teoh Beng Hock's death in Shah Alam on Dec 19 last year was murder.
It looks like the police are not aware of their basic duties, responsibilities and the requirements under the law to produce the evidence of a police report made prior to an attempt to obtain statements from a person whose name was mentioned in the police report charging him for any wrongdoing.
Apart from that, the Selangor police chief had also indeed lied to the people by providing false press statement with an attempt to destroy the reputation of the Lim as Penang Chief Minister and head of the state government. Was he doing for and on behalf of the Umno-led federal government? Well, we need to ask him about that. What we had observed here is Datuk Khalid was being too personal over this issue and thus, failed to act professionally in discharging his duties as a state police chief.
More people will suffer if we have more of such police officers around, as this is considered a blantant power abuse and mismanagement of the force. Their actions is of more political motivated rather than public security. That is why the crime rate is increasing almost everyday.
In this case, we really need the Independent Police Complaints and Misconduct Commission (IPCMC) to be established in order to address various mismanagements and ineffective systems in the police force.
