The Facts in the Federal Constitution

Article 3 : Ugama Bagi Persekutuan

Reads (1) Ugama Islam ialah ugama bagi Persekutuan, tetapi ugama-ugama lain boleh diamalkan dengan aman dan damai di mana bahagian Persekutuan.

It means Islam is an official religion of the Federation but other religions are allowed to be practiced in peace and order in any areas of the Federation. So far, do we really enjoy meaning of this article? The construction of places of worship are still restricted only to certain areas or residence. Where is the real freedom of religion?

Nothing in any part of the Federal Constitution had ever mention that Malaysia is an Islamic state. As such, Malaysia is a Secular State, truly a Secular State.

Article 8 : Sama Rata

Reads (1) Semua orang adalah sama rata di sisi undang-undang dan berhak mendapat perlindunganyang sama rata di sisi undang-undang.

and (2) Kecuali sebagaimana yang dibenarkan dengan nyatanya oleh perlembagaan ini, tidaklah boleh ada perbezaan terhadap warganegara semata-mata oleh sebeb ugama, kaum, keturunan atau tempat lahir dalam mana-mana undang-undang atau dalam perlantikan bagi mana-mana jawatan atau pekerjaan di bawah sesuatu pihak berkuasa awam ...........

The racist party called Umno has been emphasizing overly on the need to expand their lordship or supremacist of one particular race and religion over the others due to the fact tat they are the majority stakeholders of this country and their bumiputraship as well.

Their supremacist and lordship ideas had in fact expanded to many areas in the administration and the socio-economic structures in our nation.

Therefore, Article 8 of the Federal Constitution had been violated by racism.

Article 10 Kebebasan bercakap, berhimpun dan menubuhkan persatuan

Reads (1)(a) Tiap-tiap warganegara adalah berhak bebas bercakap dan mengeluarkan fikiran.

and (1)(b) Semua warganegara adalah berhak berhimpun secara aman dan dengan tidak bersenjata.

and (1)(c) Semua warganegara adalah berhak menubuhkan persatuan.

Again this 3 clauses in Article 10 has been restricted by Internal Security Act, Official Secrets Act, Sedition Act, Police Act and partially by the Societies Act. Some clear examples and fact do happened in front of our eyes.
  1. Those who come up peacefully to light candles in memory of a murdered victim of injustice were summarily arrested and put into the prison with improper trial and warrant.
  2. Those who spoken on facts and figures of their encounter on various power abuses and corruptions by powerful political elites were arrested and charged under the Official Secrets Act.
  3. It took about more than 10 years to have the Parti Sosialis Malaysia (PSM) to be registered as a political party to contest in the general elections, but it took a mere 6 months to register Parti Cinta Malaysia (PCM), a splinter party formed by some dissident MCA and Gerakan members.
  4. Penang Chief Minister Lim Guan Eng is in the opinion that a Selangor Exco member's political aide Teoh Beng Hock has been murdered. And now the police is going after him and his opinion.
  5. When Pakatan Rakyat hold meetings and conventions to explain their programmes to the people, the police special branch put up cameras and recorded every words that the party leaders said in their speeches, but when Barisan Nasional, Umno or even Perkasa leaders hold violent rallies, demonstrations, issued threats to kill and to harm the public order, the police just stood there empty handed doing nothing at all.
  6. We cannot talk and brief our fellow citizens about peace, justice, freedom and democracy but Umno and Perkasa leaders are allowed to issue threats, calling for bloodshed, making racist attacks, act violently, burning effigies and so many other uncivilized manners.
Unfortunately, with all the powers in their hands, Umno leaders are now turning the Federal Constitution into a mere old newspaper. Whatever they are doing currently are in direct conflict with the Federal Constitution.

Unfortunately, the Federal Constitution has been treated with disrespect by these racist political leaders who are going all out to ensure their powers and position remains for the rest of their life.
